The Kahnawake licence: the oldest online gaming regulator

Before Malta, before Curaçao was a byword and long before Ireland had a gambling regulator, a Mohawk community on the banks of the St Lawrence was licensing online casinos. The Kahnawake Gaming Commission has been at it since 1996.

A regulator on a reserve outside Montreal

Kahnawake is a Mohawk territory on the south shore of the St Lawrence River, across from Montreal in Quebec. The Mohawk Council of Kahnawake asserts jurisdiction over gaming on its territory, and in 1996 it enacted the Kahnawake Gaming Law and set up the Kahnawake Gaming Commission to apply it. The Commission began licensing online gaming soon after, making it one of the earliest bodies anywhere to regulate internet casinos.

Its position is unusual. Its authority derives from the community's assertion of sovereignty rather than from a national parliament, and Canadian and provincial authorities have not always seen things the same way. For a player, the relevant point is practical: the Commission publishes its regulations, licenses operators, runs a complaint process and has a thirty-year record you can look at.

The licences it issues

The main Kahnawake authorisations
AuthorisationWhat it is for
Interactive Gaming LicenceAllows a company to host gaming operations in the Commission's approved data centre on the territory
Client Provider AuthorizationGranted to the operator that actually offers games to players, hosted under an Interactive Gaming Licence
Key Person LicenceRequired for individuals who control or manage a licensed operator

Historically the data-centre model was central: operators' servers sat at a facility on the territory, which gave the Commission physical oversight of the systems it licensed. That model is less distinctive today, but it explains why Kahnawake built its reputation around technical supervision.

A record you can actually look at

The clearest test of any regulator is what it does when something goes badly wrong. Kahnawake's best-known case came in 2007 and 2008, when insider cheating was uncovered at two online poker rooms it licensed, Absolute Poker and UltimateBet. The Commission investigated, published its findings, imposed fines and required affected players to be refunded. It was not a flattering episode for anyone involved, but it showed a regulator willing to act in public, which is more than many could claim at the time.

How a complaint works

  1. Raise it with the operator in writing and give it a reasonable time to answer.
  2. If you remain unsatisfied, file a complaint with the Commission through the procedure published on its website, with your account details and evidence.
  3. The Commission reviews the complaint and can require the operator to respond, and it can take regulatory action against a licensee that has breached its regulations.
  4. Keep everything: dates, amounts, screenshots, the relevant terms. A regulator can only act on what you can show.

Checking a Kahnawake licence

Does Kahnawake still matter in 2026?

Less than it did in the early 2000s, when it hosted a large share of the world's online poker. Canadian provinces now run their own online platforms, and Ontario opened a regulated private market in 2022, so the North American landscape around the Commission has changed completely. It still licenses operators, publishes decisions and answers complaints, and its long record makes it a useful reference point when you are weighing a younger authority.

Where it fits among the others

Kahnawake is best known in North America, particularly for poker and for operators serving Canadian players. In Europe you are more likely to meet the Malta Gaming Authority or the UK Gambling Commission, and among newer casinos, Curaçao or Anjouan. Ireland's own regulator, which will open online gaming licences in 2027-2028, is covered on the GRAI page, and every guide is listed on casino licences explained. The games themselves are on popular casino games.

The permit list, and what a gap in it means

Because the Commission publishes who holds its permits, it is possible to do something that is harder with some newer regulators: notice when a brand disappears. Operators leave for ordinary reasons — a merger, a move to another licence, a market exit — and occasionally for regulatory ones. If a brand you use still shows a Kahnawake badge but no longer appears on the list, ask its support team which authority now covers your account, and get the answer in writing before you deposit again.

The same list is useful in the other direction. Some operators quote an authorisation that belongs to a sister company or to a hosting arrangement rather than to the business you are actually dealing with. Matching the exact company name, rather than the brand, is what catches that.

What thirty years teach

Longevity is not proof of perfection, and Kahnawake's history includes disagreements and difficult cases. But a regulator that has handled scandals in public, published its rules and kept licensing for three decades has given players something to judge it by. That, in the end, is what you want from any name in a footer: enough of a record to decide for yourself.

Frequently asked questions

What is the Kahnawake Gaming Commission?

The regulator of gaming in the Mohawk Territory of Kahnawake, near Montreal in Quebec. It was set up in 1996 and was one of the first bodies to license online casinos.

What licences does Kahnawake issue?

Mainly Interactive Gaming Licences for hosting, Client Provider Authorizations for operators offering games to players, and Key Person Licences for the people who run them.

Can I complain to the Kahnawake Gaming Commission?

Yes, once you have tried the operator's own procedure. The Commission publishes a complaint process and can take action against licensees that breach its regulations.

Is Kahnawake recognised in Canada?

Its authority rests on the Mohawk community's assertion of jurisdiction, which Canadian and provincial authorities have not always accepted. It has nonetheless licensed and supervised operators continuously since 1996.
